Alimony

Alimony

Alimony is available to either spouse in Massachusetts.  The length the marriage, needs of the parties and the ability to pay are all issues which the court will examine to determine the amount of alimony.  In  Massachusetts new alimony guidelines are in use and the alimony law has been recently amended.  Alimony can be modified in most cases.  It can also be the subject of a Contempt action should the payor spouse fail to pay the obligation.  Special rules will apply in cases involving  both  children’s support and alimony.   There are 19 statutory elements you need to prove.  You must present sufficient evidence to establish each element persuading  the Judge to award you alimony and a favorable division of asset.
