Sometimes emotions run high during a divorce or in a relationship.  A restraining order can be obtained if the parties have a marital relationship,  living together or in a  dating  relationship.   You may obtain a restraining order, or order of protection in the District Court or in the Probate and Family Court.  Unlike a 209A order,  a  G.L. c. 258E, Harassment Prevention Order  can be obtained by persons not in a dating relationship such as neighbors.   Harassment Prevention Orders can only be obtained in the District Court, Boston Municipal Courts and in the Superior Court.  The place to obtain such order is where the plaintiff (injured party) resides.  G.L. c. 258E, Harassment Prevention  is defined as 3 or more willful and malicious acts aimed at a specific person causing  fear, abuse, or damage to property.     All orders of protection may be modified.  Both kinds of protection orders may stop abuse, order no contact, stay away from victim and/or order child support and custody.
