Will I get custody of the children?

In determining an award of custody the court shall examine what is in the best interest of the children, the  fitness of the parents and in cases with older children give consideration to the child’s expressed preference.  Sole custody and shared custody can be agreed to by the parties or ordered by the court.

What is sole custody vs. shared custody?

Sole physical and legal custody is when the chld resides with one parent and that parent has the responsibility for the decisions regarding the child’s education, health and welfare.

Joint or shared custody is where both parent establish a parenting plan and share the responsibilities for the child decisions.  In this type of situation it is important that the parents are able and willing to cooperate for the best interest of the children.

What if we come to an agreement on custody and visitation?

Often parents do come to an agreement on custody and visitation because they have the most knowledge about what is in the children best interests.   The court will usually accept  the parties agreement regarding custody of the children.  However when the parties can not agree then the court will likely appoint an investigator to report to judge about what is going on and what is in best interest of children.  An investigator will speak with teachers, doctors and your friends who know you and know your relationship with the children.  These are difficult decisions and the court will responsibly seek out as much information and evidence before it makes a decision on custody and visitation.
